Welcome to getMindmap (the "Service"), operated by The Faculty Club SLU ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and software, including any content, functionality, and services offered on or through getMindmap.com.
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.
You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.
2. Service Description
getMindmap is a Software-as-a-Service (SaaS) platform that allows users to interact with a tool similar to a Large Language Model assistant, but with enhanced visualization capabilities. The Service enables users to upload and process queries, PDFs, and other content. It generates visual outputs such as mind maps and concept maps that synthesize and present information in a visual format, ideal for research, learning, and analysis.
The Service may rely on third-party providers (for example payment, authentication, hosting, analytics, AI model, or connector providers such as ChatGPT integrations). Your use of those services may also be subject to their own terms and policies.
AI-generated outputs may be incomplete or inaccurate. You are responsible for reviewing and validating outputs before relying on them.
3. User Accounts
To use our Service, you may need to create an account by providing your name, email address, and other required information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.
4. Subscription and Payment
- Subscription Plans: Access to our Service is offered on a subscription basis with various plans available, including weekly, monthly and yearly options. We also offer a lifetime plan. Details of the available plans, including fees and features, are available on our website.
- Free Trial: We offer a free trial period for new users. At the end of the trial, you will be automatically charged based on the subscription plan you selected at sign-up unless you cancel before the trial ends.
- Payment: Subscription fees are billed in advance on a recurring basis as specified at the time of purchase. You agree to pay all charges incurred under your account, including applicable taxes.
- Cancellation: You may cancel your trial or subscription at any time by accessing the customer portal. Cancellations will take effect at the end of the current subscription period, and you will retain access to the Service until that time.
- Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel before the renewal date.
- Refunds: We generally do not offer automatic refunds. However, we may provide a full or partial refund, at our discretion, for good-faith requests (for example accidental charges, duplicate payments, or clear billing errors).
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Upload or transmit any content that is unlawful, harmful, defamatory, or infringing on any third-party rights.
- Upload or transmit content that violates privacy rights, includes malware, or contains exploitative, abusive, or illegal material.
- Attempt to gain unauthorized access to our systems, networks, or underlying code.
- Use techniques such as prompt injection, reverse engineering, decompiling, disassembling, or any other method designed to manipulate, interfere with, or gain access to the code, algorithms, or functioning of the Service, including how we manage AI models.
- Deploy automated scripts, bots, or other means to extract, scrape, or otherwise collect data from the Service without authorization.
- Attempt to bypass any security or access controls implemented by us to protect the integrity of the Service.
We may suspend or terminate access to the Service, with or without notice, if we reasonably believe you violated these Terms, created security or legal risk, or used the Service in a way that may harm us, other users, or third parties.
6. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of The Faculty Club SLU and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any of our content without our express written permission.
7. Data Processing and Privacy
By using the Service, you agree that we may collect, store, and process data as described in our Privacy Policy. You retain ownership of your uploaded content, but you grant us a license to use, store, and process the content as necessary to provide the Service.
8. Disclaimers and Limitation of Liability
- Disclaimers: The Service is provided "as is" and "as available." To the extent allowed by law, we make no warranties (express or implied), including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.
- Service Availability: We may update, suspend, or discontinue all or part of the Service at any time, including for maintenance, security, or provider-related issues.
- Limitation of Liability: To the fullest extent permitted by law, The Faculty Club SLU is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages related to your use of the Service.
- Liability Cap: To the fullest extent permitted by law, our total liability for any claim related to the Service or these Terms is limited to the total fees you paid to us for the Service in the 12 months before the event giving rise to the claim.
- Force Majeure: We are not liable for delays or failures caused by events outside our reasonable control, such as internet outages, provider failures, utility disruptions, labor disputes, government actions, or natural events.
9. Indemnification
You agree to defend, indemnify, and hold harmless The Faculty Club SLU, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts of Madrid, Spain.
11. Changes to the Terms
We may update these Terms from time to time by posting the latest version on our website. For material changes, we will make reasonable efforts to notify you in advance (for example, by website notice or email). Continued use of the Service after the updated Terms take effect means you accept the updated Terms.
